Federal Judge Orders Release of Kilmar Abrego Garcia from Immigration Custody
A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement lacks lawful basis.
"Since his release after wrongful detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her order.
The case stems from a erroneous deportation to El Salvador earlier this year, which the government later admitted was an mistake. After his return to the United States to face human smuggling charges, he was detained in federal detention.
In her order, the judge noted that the authorities does not have a current removal order, which prevents them from removing Mr. Abrego Garcia "for now."
Context of the Legal Challenge
The court proceedings involve disputed assertions. Whereas the former administration contends that Abrego Garcia is a affiliate of the MS-13 gang, he categorically denies this allegation.
He has also pleaded not guilty to the smuggling charges, which are part of a ongoing trial in the state of Tennessee.
Conditions of Freedom
The judge, who was hearing his challenge to deportation in a federal court, ruled that he must now adhere to the conditions of his bond from custody in Tennessee. This decision effectively transfers his monitoring to the Tennessee court.
This ruling marks a notable turn in a complex immigration case featuring allegations of mistaken imprisonment and contested gang associations.
